Introduction to Fundamental Rights
The Constitution of Pakistan 1973, under Part II, Chapter 1 (Articles 8–28), guarantees fundamental rights to all citizens. These rights are the bedrock of democracy and are enforceable by the High Courts and the Supreme Court of Pakistan.
Core Fundamental Rights (Articles 8–28)
- Security of Person & Fair Trial: Articles 9, 10, and 10A (Right to Fair Trial).
- Freedom of Expression: Articles 19 and 19A (Right to Information).
- Equality of Citizens: Article 25 and Article 25A (Right to Education).
- Inviolability of Dignity: Article 14 (Privacy of home and dignity of man).
Recent Supreme Court Judgments (2023–2026)
In recent years, the Supreme Court has further strengthened these rights through landmark interpretations regarding civil liberties, due process, and the protection of marginalized groups. This section analyzes how the judiciary has balanced state security with individual freedoms in the 2023–2026 period.
How to Enforce Your Rights
Citizens can invoke the constitutional jurisdiction of the High Courts under Article 199 or the Supreme Court under Article 184(3) if their fundamental rights are violated by the state.
