What is Mens Rea and Actus Reus Under Pakistan Penal Code
In criminal law of Pakistan, no crime is complete without two essential elements: Mens Rea and Actus Reus. The famous principle is “Actus non facit reum nisi mens sit rea” which means act alone does not make a person guilty unless his mind is also guilty.
Mens Rea – The Guilty Mind
Mens Rea refers to the mental element or intention behind committing a crime. It is the state of mind of accused at the time of offence. In Pakistan Penal Code, mens rea is shown through words like “intentionally”, “voluntarily”, “dishonestly”, “fraudulently”, “knowingly”.
Types of Mens Rea in Pakistan
1. Intention: Direct purpose to cause result, e.g., intention to kill in murder (Section 300 PPC).
2. Knowledge: Awareness that act will cause certain result, e.g., knowledge that injury may cause death.
3. Negligence: Failure to take reasonable care, e.g., rash driving under Section 279 PPC.
4. Recklessness: Taking unjustifiable risk knowing the consequence.
5. Motive vs Intention: Motive is reason behind act (e.g., revenge), while intention is immediate purpose. Motive is not always necessary to prove crime.
Actus Reus – The Guilty Act
Actus Reus is the physical act or unlawful omission. It includes action, circumstance, and result. For example, in theft (Section 378 PPC), moving of property is actus reus.
Are Both Necessary?
Yes, for most crimes both must exist together. If a person takes your mobile by mistake thinking it is his own, there is actus reus (taking) but no mens rea (dishonest intention), so no theft.
Exceptions Where Mens Rea is Not Required – Strict Liability
In some offences under Pakistani law, mens rea is not needed:
1. Public nuisance (Section 268 PPC)
2. Sale of adulterated food
3. Traffic offences
4. Cases under certain special laws like Price Control Acts
In such cases, only act is enough to punish.
Importance in Court
Prosecution must prove mens rea beyond reasonable doubt. If prosecution fails to prove guilty mind, accused is entitled to benefit of doubt and acquittal. The landmark judgment PLD 1957 FC 157 explains importance of mens rea.
