How to Get Khula in Pakistan – Complete Procedure, Fees and New Law 2026

Khula is the right of a woman to get separated from her husband in Islam and under Pakistani law. If a husband is not willing to give divorce, wife can file Khula in Family Court.

Grounds for Khula in Pakistan:
Under Dissolution of Muslim Marriages Act 1939, a woman can file Khula on following grounds:
1. Husband absent for 4 years
2. Husband failed to provide maintenance for 2 years
3. Husband second marriage without permission
4. Husband cruelty or beating
5. Husband impotent or mentally ill

Step by Step Procedure 2026:

Step 1: Hire a Family Lawyer
You need a good family lawyer. He will draft Khula application for you.

Step 2: File Suit in Family Court
Your lawyer will file Khula suit in local family court with Nikahnama copy, CNIC copies, and children’s B-Forms if any.

Step 3: Court Notice to Husband
Court will send notice to husband. Husband has to appear within 15-30 days.

Step 4: Reconciliation Attempt
Court will try reconciliation between husband and wife. This is compulsory under Family Laws.

Step 5: Husband Fails – Khula Granted
If reconciliation fails, court will grant Khula decree. Usually takes 2-3 months in 2026.

Fees for Khula in Pakistan:
Court fee is Rs. 1000-1500 only, but lawyer fee is Rs. 35,000 to Rs. 75,000 depending on city. In Lahore, Islamabad and Karachi fee is higher.

Do You Have to Return Haq Mehar?
Yes, in most cases wife has to return 50% or 100% Haq Mehar if Khula is granted.
