This Act shall be read subject to every enactment heretofore or hereafter passed relating to any C ourt of Wards by 3 [any co m petent legislature, authority or person] in 4 [Pakistan] , and nothin g in this Act shall be construed to affect, or in any way derogate fro m , the jurisdiction or authority of any C ourt of Wards, or to take away any power possessed by 5 [any High Court 6 [* * *]. 4. Pow e r o f t h e Co u r t to m a k e o r d e r as to g u a r d ia n s h i p . — (1) W h e re the C ourt is s a ti s f i e d t h a t it is f or t h e w e lf a re o f a m inor th a t a n ord e r should be m a d e — ( a ) a ppointing a g u a rdi a n o f his p e rson or prop e rt y , or bo th, or ( b ) d ec l a ring a p e rson to b e s u c h a g u a rdi a n, the C ourt m a y m a ke a n ord e r a c c ordin g l y . Form of application. — ( 1 ) If the a ppli ca tion i s not ma de b y the C ol1 ec tor, it shall be by p e tition si g n e d a nd ve ri f i e d in ma nn e r pr e s c rib e d by the 1 [C o d e o f C i v il Procedure, 1908] (A c t V o f 1908) fo r the si g ning a nd ve ri f i ca tion of a p la int, a nd s t ati n g , so fa r a s ca n be ascertained, — ( a ) the n a m e , s e x, r e li g ion, d a te o f bir th a nd ordi n a ry r e sid e n c e o f t h e m inor; ( b ) wh e re the m inor is a f e m a l e , w h e th e r s h e is ma rri e d, a nd, i f so, t h e n a m e a nd a g e of h e r husb a nd; ( c ) the n a tur e , sit u a tion a nd a pproxi m a te v a l u e of the prop e rt y , if a n y , of the m inor; ( d ) the n a m e a nd r e s id e n c e o f the p e rson h a v ing t he c u s tody or poss e ssion of th e p e rson or prop e rty of the m inor; ( e ) wh a t n e a r r e l a tions t h e m inor h a s, a nd wh e r e t h e y r e s i d e ; ( f ) wh e th e r a g u a rdi a n o f t h e p e rson or prop e rt y , or both, of t h e m inor h a s b e e n a ppoin t e d by a ny p e rson e ntit l e d or c l a i m ing to be e nti t l e d by the l a w to w h i c h the m inor is su b j e c t to m a ke s u c h a n a ppoi n t m e n t; ( g ) wh e th e r a n a ppl i ca t i o n h a s a t a ny ti m e b e e n m a de to t h e C ourt or to a n y oth e r C ourt with r e sp e c t to t h e g u a rdi a nship o f the p e rson or prop e rt y , o r bo t h, of the m inor, a nd, if so, wh e n, to wh a t C ourt a nd with wh a t r e sult ; ( h ) wh e th e r the a ppl i c a t i on is f or t h e a ppoint m e nt or d ec l a r a t ion of a g u a r di a n o f the p e rson o f t h e m inor, or of his prop e rt y , or of both; ( i ) wh e re the a pp l i c a ti o n i s to a ppoint a g u a rdi a n, t h e q u a l i f i ca t ions of th e propos e d g u a rdi a n; ( j ) wh e re the a ppl i c a tion is to d e c l a re a p e rson to b e a g u a rdi a n, the g rounds on whi c h th a t p e rson c l a i m s ; ( k ) the c a u s e s whi c h h a v e l e d to the m a king of t h e a ppl i ca t i on; a nd ( I ) su c h oth e r p a rt i c u l a r s, if a n y , a s m a y be pr e s c rib e d or a s t h e n a ture of t h e a ppl i ca t ion r e n d e rs it n ec e ss a ry to st a t e . Procedure on admission of application. — (1) If the Cou rt is satisf ied that there is ground for proceeding on the application, it shall fix a day for the hearing thereof and cause notice of the application and of the date fixed for the hearing — (a ) to be served in the manner directed in the 1 [Code of Civil Pr ocedure, 190 8], (Act V of 1908) on — (i) the parents of the minor if they are residing in 2 [Pakistan], (ii) the person, if any, named in the petition or letter as having the custody or possession of the person or property of the minor, (iii) the perso n proposed i n the application letter to be appointed or declared guardian, unless that person is himself the applicant, and (iv) any other person to whom , in the opinion of the Court, special notice of the application should be given; and (b ) to be post ed on some c onspicuous part of the courthouse, and of the residence of the minor, and otherwise published in such manner as the Court, subject to any rules made by the High Court under this Act, thinks fit. (2) The 3 [Provincial Government] may, by general or special order, require that, when any part of the property described in a petition under section 10, sub - section (1), is land of which a Court of Wards could assume the superintendence, the Court shall also cause a notice as aforesaid to be served on t he Collector in whose district the minor ordinarily resides, and on every Collector in whose district any portion of the land is situate, and the Collector may cause the notice to be published in any manner he deems fit. (3) No charge shall be made by th e C ourt or t he Collec tor f or the service or publication of any noti c e served or published und e r sub - section (2). 12.
