How to File Workplace Harassment Complaint Under Protection Against Harassment of Women at Workplace Act 2010*
Workplace harassment is a serious crime in Pakistan. Under the Protection Against Harassment of Women at the Workplace Act 2010, every organization must have an Inquiry Committee and a Code of Conduct displayed.
Harassment includes any unwelcome sexual advance, demand for sexual favor, verbal or physical conduct of sexual nature, or creating hostile work environment.
*Procedure to File Complaint*
1. *Internal Complaint:* The victim can file a written complaint to the Inquiry Committee of her own organization within 3 months of incident. The Committee must be of three members including one woman.
2. *To Ombudsman:* If there is no committee, or victim is not satisfied with committee’s decision, she can directly file complaint to Federal Ombudsman for Protection Against Harassment or Provincial Ombudsman in Punjab, Sindh, KPK, Balochistan.
3. *Evidence:* Complaint should mention date, time, place, and name of harasser. Any WhatsApp chats, emails, or witness can be attached.
4. *Inquiry:* The Inquiry Committee or Ombudsman has to complete inquiry within 30 days. The accused is given chance to defend.
*Punishments*
If harassment is proved, punishments include censure, withholding promotion, dismissal from service, fine up to 500,000 rupees, and compensation to victim. If false complaint is filed, the complainant can also be punished.
All government and private offices are legally bound to implement this Act. Every organization must display the code in both English and Urdu.
